HON'BLE MR.JUSTICE GOVIND MATHUR Mr. R.S.Saluja, for the petitioner. .... This petition for writ is preferred to assail validity, propriety and correctness of the order dated 21.5.2007 passed by the Controlling Authority under Payment of Gratuity Act, Banswara. The order aforesaid is appealable under Section 7(7) of the Payment of Gratuity Act, 1972, thus, I do not consider it appropriate to interfere with the matter in extraordinary jurisdiction of this Court by ignoring the statutory remedy available. The writ petition, therefore, is dismissed. However, it shall be open for the petitioner to prefer an appeal within a period of two weeks from today. If such appeal is preferred, that shall be considered including the question of limitation, by the appellate authority in accordance with law. ( GOVIND MATHUR ),J. Kkm/ps.
