HON'BLE MR. RAJESH BALIA,J. HON'BLE MR. BHANWAROO KHAN,J. Mr. N.M.Lodha, AAG Mr. Akhilash Raj Purohit, for the respondent. This appeal is directed against the judgment of learned Single Judge dated 24.8.04 which reads as under:-
Heard. Learned counsel points out that against this very impugned order S.B.C.W.P. No. 913/03 (DR/J) and 1315/03 (DR/J) have already been dismissed on 10.03.2004. In view of the fact that against this very impugned order, the aforesaid writ petitions have already been dismissed, this writ petition is also dismissed.
It has been pointed out by learned counsel for the respondent that appeal against the aforesaid judgment has since been dismissed and it has not been pointed out that number of writ petitions arising out of same order of the Rajasthan Civil Services Tribunal dated 27.3.2000 passed in the seven appeals of seven different appellants had met the same fate. From the 2 perusal of the orders passed in other petitions arising out of the same order on behalf of the different petitioners, the writ petitions were dismissed by learned Single Judge on the ground of delay and latches. In this case also, against the order of the tribunal, writ petition has been filed after more than 3 years from the date of the order dated 24.8.2004. Moreover, the order of the tribunal has already been implemented in the most of the cases. In these circumstances, no interference is called for on the merit of the appeal.
