Ms. Yogita Mohnani, for the petitioner. Mr. Ashok Prajapat, PP, for the State. Heard learned counsel for the petitioner and the learned Public Prosecutor and perused the material available on record. Learned counsel for the petitioner submits that similarly situated co-accused has already been enlarged on bail and the case of the present petitioner stands on same footing. Hence, he should be enlarged on bail. Having gone through the facts and circumstances of the case and without expressing anything on the merits of the case, I am inclined to grant bail under Section 439 Cr.P.C. Accordingly, the same is allowed and it is directed that petitioner Ekma Ram S/o Shri Pukhraj shall be released on bail in FIR No.323/2011 P.S. Jaitaran, District Pali, provided he executes a personal bond for a sum of Rs.30,000/- along with two sound and solvent sureties in the sum of Rs.15,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
