Heard learned counsel for the petitioners and the learned Public Prosecutor and perused the material available on record. Learned counsel for the petitioners submit that there is no evidence against the present petitioners. They have been implicated in the matter only on the suspicion and conjectures and similarly situated co-accused Prakash and Kalulal have already been released on bail. Learned Public Prosecutor submits that belt has been recovered from petitioner Bheru S/o Uda. Having gone through the facts and circumstances of the case and without expressing anything on the merits of the case, I am inclined to grant bail under Section 439 Cr.P.C. Accordingly, the same is allowed and it is directed that petitioners (1) Bherulal Dhakar S/o Shri Uda Dhakar, (2) Chitarmal Dhakar, (3) Bheru S/o Mohan Dhakar and (4) Laxman S/o Nanda Dhakar shall be released on bail in FIR No.121/2011 P.S. Bijaypur, District Chittorgarh, provided each of them executes a personal bond for a sum of Rs.50,000/- along with two sound and solvent sureties in the sum of Rs.25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
