Judgment

HON'BLE MR. JUSTICE GOPAL KRISHAN VYAS Mr.Rajesh Shah, for the petitioners. Mrs. Pramila Acharya, for the respondents. Heard learned counsel for the parties. By way of filing present writ petition, the petitioners are challenging the order dated 01.10.2005 passed by the Commissioner, Workmen Compensation Act, 1923, whereby the application filed by respondent No.2 for setting aside the ex parte proceedings was allowed. I have perused the impugned order. I see no reason to interfere with the writ petition. It is a case of compensation of deceased workman, therefore, in the 2 interest of justice, the respondent No.1 - Commissioner, Workmen Compensation Act, 1923, Sirohi is directed to decide this case within a period of three months. With the above direction, the writ petition is disposed of. A.K. Chouhan/- (GOPAL KRISHAN VYAS), J.
