HON'BLE THE ACTING CHIEF JUSTICE MR. RAJESH BALIA HON'BLE MR. JUSTICE BHANWAROO KHAN None present for the appellant. Mr. N.M. Lodha, Additional Advocate General Mr. Jagdish Vyas, for the respondent. Learned counsel for the respondent states that there were four appeals raising same issue which arose out of the same accident. The principal judgment of the learned Single Judge was rendered in S.B. Civil Misc. Appeal No. 1047/86 dismissing the appeal by a separate order on the same date and he further states that out of four misc. appeals, appeals in two of the matters have since been dismissed for want of prosecution and have not been restored so far his knowledge goes.
