Provisions considered

Judgment

HON'BLE MR.JUSTICE G.S.SARRAF Mr. M.K.Garg, for the petitioners. Mr.S.N.Tiwari, Public Prosecutor. Mr.Narpat Singh for complainant. Heard learned counsel for the petitioner and the learned Public Prosecutor. The petitioners were convicted by Additional Munsif and Judicial Magistrate, Ist Class, Pali by judgment dated 16.2.1987 u/s 448 IPC and each of them was sentenced to imprisonment for six months with a fine of Rs.50/- and in default of payment of fine, they were ordered to undergo further imprisonment for 15 days. The petitioners filed an appeal. Additional Sessions Judge, Pali by judgment dated 12.7.1994 maintained the conviction of the petitioners u/s 448 I.P.C. but instead of sentencing them at once to any punishment directed that they be released on probation of good conduct for keeping peace and be of good behaviour for a period of one year on furnishing personal bond and surety bond in the sum of Rs.3,000/- each . Aggrieved by this, the petitioners filed this revision petition. Learned counsel for the petitioners admits that the petitioners have submitted personal bond and surety bond in compliance of the order dated 12.7.94 of the Additional Sessions Judge, Pali and the period of probation is over. Since the petitioners have complied with the judgment of the Additional Sessions Judge, Pali and the period of probation is over long back, therefore, this criminal revision petition has become infructuous. The revision petition is accordingly dismissed. (G.S.SARRAF),J.
