These intra-court appeals have been preferred as against the decision rendered by the Single Bench in bunch of 503 writ applications decided by a common order on 15.5.2009. Single Bench of this Court has followed the decision rendered by the Single Bench in Sarita Vs. State of Rajasthan (2010 (1) RLW 275 (Raj.)) in which direction was issued to continue Vidhyarthi Mitras (teachers) till regularly selected candidates are available. 20 The facts in short are that the respondents were appointed as Vidhyarthi Mitras. The Scheme was framed by the State of Rajasthan initially on 7.9.2006 mentioning that there were large number of vacant posts and it was not possible to fill up the vacancies by the prescribed mode of selection by the Rajasthan Public Service Commission nor it was possible to hold Departmental Promotion Committee. Consequently in the interest of education, its availability, and continuance of education, it was considered appropriate to frame a scheme called as “Vidhyarthi Mitra Yojana”. The appointments were to be made on fixed amount, however, the appointments were made on contract basis for the particular academic session. The petitioners had been appointed as Vidhyarthi Mitras under similar circular dated 2.6.2008. There were 6000 vacancies of Lecturers, 5000 vacancies of Senior teachers and 1250 vacancies of Teacher Gr. III. The scheme was approved by the Finance Department vide circular dated 09.01.2007. The appointments which were made, were to be continued till 29.2.2009, however as February, 2009 was of 28 days, a corrigendum was issued and term was extended till 15.4.2009. As the term of appointments were extended upto 15.4.2009, several petitions were filed. Interim orders were passed not only at Principle Seat but at the Bench at Jaipur also. Bunch of writ petitions was decided by the Jaipur Bench in Sarita Vs. State of Rajasthan (supra). The stand of the State Government is that appointments were contractual, no mandamus can be issued in such matters. There is no justifiable reason to invoke the writ jurisdiction of this Court in view of the decision in Secretary, State of Karnataka & Ors. Vs. Uma Devi & Anr. AIR 2006 SC 1806, the appointments were made only under temporary scheme. The scheme was introduced for providing additional benefit to 21 students in rural areas for this particular Session 2008-09. The petitioners had no right to invoke writ jurisdiction to extend it. It was introduced to provide additional educational facility in remote villages and to fill up the temporary gap and that too, on contractual basis for the fixed term and on fixed honorarium. In Rajasthan Educational Service Rules, 1971 and in Rajasthan Educational Subordinate Service Rules, 1971, complete procedure has been provided for recruitment through the Rajasthan Public Service Commission. During pendency of the matters, now power has been conferred to Zila Parishad as submitted by Shri R.L. Jangid, learned Additional Advocate General, appearing on behalf of the State. The appointments were not made as per rules. The scheme was framed to provide better and more teaching facility to the students temporarily. The Single Bench in Sarita Vs. State of Rajasthan (supra) has issued following directions in para 36 of the decision. In para 36 thus- “36. Accordingly, the writ petitions are disposed of as under:- I. During continuation of the work, as detailed out hereinabove, the invocation of the last extension is arbitrary and illegal; and the consequential automatic termination orders of the petitioners are set aside. II. The RPSC/DPC selected candidates/employees are still not available and next academic session is about to start; even urgent temporary appointments under Rule 28 of the Rules of 1971 are not possible due to short span of one month and a half left to start with the process of admission and academic session, therefore, as per the aims and objects of the Scheme, respondents are directed to consider the cases of the petitioners for continuation in service till regularly sleected candidates from RPSC/persons selected and recommended by the DPC for promotion are made available in the light of the above observations; III.Even in case of appropriate order of continuation in service till regularly selected candidates from RPSC/DPC selected persons are available, the petitioners are not 22 entitled for wages of the vacations in other words, when the schools are closed. IV.In case the regularly selected candidates from RPSC/persons selected and recommended by the DPC for promotion are made available, then the respondents can terminate services of the petitioners after preparation of the seniority list on the State Level as per their date of appointment and merit assigned to them, by following the principle of 'last come first go' to the extent of availability of the selected candidates and while doing so, the respondents will keep the interest of the present students and prospective students in view.” The Single Bench at Jodhpur while deciding the matters in question has followed the decision rendered in Sarita Vs. State of Raj. (supra). It has been ordered that in the interest of education of students as the posts have not been filled in so far on regular basis, it is desirable to continue the Vidhyarthi Mitras till regular selections on the various posts is made in accordance with rules. Aggrieved by the decision rendered, the instant intra-court appeals have been preferred. Shri R.L. Jangid, learned Additional Advocate General appearing on behalf of the State has submitted that the scheme itself was temporary and appointments were contractual, consequently, no mandamus could have been issued to continue the candidates, the contract came to an end by efflux of time. Shri Jangid further submitted that selection process was supposed to be completed by RPSC as there was delay on part of the RPSC in starting the process of regular selection. The State Government has taken a decision now to delegate the power of appointments of teachers in such schools to the District Establishment Committee of Zila Parishad. Thus, efforts are being made to appoint the regular incumbents, no command could have been issued to continue incumbents who were not regularly selected. Mr. Jangid has further submitted that in light of the decision of Apex Court in 23 Secretary, State of Karnataka Vs. Uma Devi (supra), the directions issued to continue such employees in service was not warranted. Shri Ramesh Purohit, Shri R.S. Chundawat, Shri Sumer Singh Rathore, Dr. S.S. Jodha, learned counsel appearing on behalf of the respondents have supported the order passed by the Single Bench rendered in Sarita Vs. State of Rajasthan (supra) and have submitted that the ad hoc employees cannot be substituted by another set of ad hoc employees nor the contractual employee can be substituted by another set of contractual employees appointed on ad hoc basis. Every year, fresh selection cannot be permitted to be made as done under the Scheme for each academic session. Making of selections every year cannot be said to be conducive in the interest of education and it gives rise to several complaints. Selecting persons every year on ad hoc basis is per se arbitrary and removing them on coming to end of the academic sessions, then starting the procedure afresh, is not conducive even for good administration or for education. Thus a direction issued to continue Vidhyarthi Mitras till regularly selection is made, calls for no interference in these intra-court appeals. It is not in dispute that there are large number of vacancies of teachers in various categories in the State as mentioned by the Single Bench. There are 6000 vacancies which were to be filled by promotions of Lecturers, 5000 posts of Senior Teachers were vacant and 1250 posts of Teacher Grade III were vacant. Thus, the State Government has taken a decision in the year 2006 introducing a Scheme as pointed out by Shri R.L. Jangid, learned Additional Advocate General. The Scheme indicates that due to inability to fill the vacancies by regular mode of selection through RPSC or by holding DPC, in the interest of education, the decision was taken to start Vidhyarthi Mitra Yojana and no doubt the 24 appointments were offered on contractual basis and on fixed honorarium. It was decided that 5066 posts were to be filled in. The said incumbents appointed as against the post of Lecturers will be paid the honorarium of Rs.4,000/-. There were 8990 vacancies of Senior Teachers. The incumbents appointed as against the post of Senior Teachers will be paid the honorarium of Rs.3,000/- per month. Thereafter the Scheme has continued on yearwise basis and every year fresh process of appointments used to be resorted to. It is apparent that in case Vidhyarthi Mitras are removed, no regularly selected persons are available to replace them. The stand taken by the State of Rajasthan in these appeals itself indicates that the object behind it to provide basic minimum educational facility in remote villages and to fill-up the temporary gaps. The said temporary gap has not yet been filled in so far and educational facility has not been provided by teachers appointed on regular basis. The ad hocism is being continued by making contractual appointment on yearwise basis on fixed honorarium. It is not in dispute that appointments have been made so as to provide the educational facility in the remote and far flung areas where the required regular teachers are still not available and whatever the facility is available, is in the form of Vidhyarthi Mitras. In our opinion, the appointments which have been made are not as per rules and they have no right to continue in service also or to stake their claim for regularisation. However, though such incumbents have no right to continue in the service but at the same time, the State cannot be permitted to take resort to making fresh recruitments every academic session to fill up the temporary gap which is being stretched. It is desirable that temporary gap should have been filled in by the State by taking appropriate action to make the regular appointments but same 25 has not been done so far and still the vacancies exist at various places. The ad hocism cannot be said to be conducive to the interest of education itself. Incumbents obtaining education in the far flung and remote areas are also entitled to obtain similar education as imparted in the metropolitans but not only that, the schools are not comparable, regular teachers are not available but at the same time, the Vidhyarthi Mitras who are teaching on ad hoc basis in such remote and far flung areas are replaced by fresh ad hoc employees in the next academic session. Making selection every year is not conducive for administration or in the interest of education, it tantamounts to wastage of time and energy for no good reason. The Vidhyarthi Mitras who had served in the previous academic session ought to have been continued in consonance with the spirit of Article 14 of the Constitution till temporary gap is filled. We are surprised that temporary gap has a tendency of becoming permanent one, this situation should not prevail. Mr. Jangid has rightly submitted that it is a fit case where the State may be directed to fill up the temporary gap as early as possible. The Single Bench in Sarita Vs. State of Rajasthan (supra) has discussed the matter in detail. Relying upon the decision of State of Haryana and Ors. Vs. Piara Singh & Ors. (1992) 4 SCC 118 = AIR 1992 SC 2130, in which the Apex Court has laid down thus- “45. The normal rule, is regular recruitment through the prescribed agency but exigencies of administration may sometimes call for an ad hoc or temporary appointment to be made. In such a situation, effort should always be to replace such an ad hoc/temporary employee by a regularly selected employee as early as possible. Such a temporary employee may also compete along with other for such regular selection/appointment. If he gets selected, well and good, but if he does not, he must give way to the regularly selected candidate. The appointment of the regularly selected candidate cannot be withheld or keep in abeyance for the sake of such an ad hoc/temporary employee. 26
46. Secondly, an ad hoc or temporary employee should not be replaced by another ad hoc or temporary employee; he must be replaced only by a regularly selected employee. This is necessary to avoid arbitrary action on the part of the appointing authority.” The Apex Court has clearly laid down in the aforesaid decision that the appointment of the regularly selected candidate cannot be withheld or kept in abeyance for the sake of such an ad hoc/temporary employee. The Apex Court has also held that an ad hoc or temporary employee should not be replaced by another ad hoc or temporary employee; he must be replaced only by a regularly selected employee. This is necessary to avoid arbitrary action on the part of the appointing authority. In the decisions rendered in State of Punjab & Ors. Vs. Supreet Rajpal & another (2007) 13 SCC 290 and in Hargurpratap Singh Vs. State of Punjab (2007) 13 SCC 292, the Apex Court has laid down that one ad hoc arrangement cannot be substituted by another ad hoc arrangement which is not at all appropriate as the persons who have gained experience will be more beneficial and useful to the colleges concerned rather than to appoint persons afresh on ad hoc basis. The order passed by the High Court was set aside and order was issued to continue the employee till regular incumbents are appointed. In State of Punjab & Ors. Vs. Supreet Rajpal & anr. (supra), the Apex Court has laid down thus- “5. Learned counsel for the appellants, during the course of hearing, had referred to an order passed by this Court in a group of several Civil Appeals, i.e. Civil Appeal No.8745 of 2003 and other appeals, in the case of Harguru Pratap Singh and Ors. Vs. State of Punjab & Ors. Etc. disposed of on 7.11.2003. Particular stress was laid on the following observations: We have carefully looking into the judgment of the High Court and other pleadings that have been put forth before this Court. It is clear that though the appellants 27 may not be entitled to regular appointment as such it cannot be said that they will not be entitled to the minimum of the pay scale nor that they should not be continued till regular incumbents are appointed. The course adopted by the High Court is to displace one ad hoc arrangement by another ad hoc arrangement which is not at all appropriate for these persons who have gained experience which will be more beneficial and useful to the colleges concerned rather than to appoint persons afresh on ad hoc basis. Therefore, we set aside the order made by the High Court to the extent the same deny the claim of the appellants of minimum pay scale and continuation in service till regular incumbents are appointed. We directed that they shall be continued in service till regular appointments are made on minimum of the pay scale. The appeals shall stand allowed in part accordingly.” In Secretary, State of Karnataka & Ors. Vs. Umadevi & Ors. (supra), the Apex Court has held that such appointments cannot be regularised. However, the instant is not the case of regularisation but the question involved is of appointing incumbents for short term on ad hoc basis. The Apex Court in Uma Devi has set aside part of the decision of Piara Singh wherein regularization of such incumbents was ordered but not the part of decision in which it has been laid down that ad hoc employee should not be replaced by another set of ad hoc employee. Rule of 'last come first go' is based on Article 14 which also indicates that person who has been appointed in last has to be removed. The spirit of Article 14 is that even the ad hoc employees are entitled for fair treatment, they cannot be removed unnecessarily. Respondents Vidhyarthi Mitras have been appointed in the interest of students obtaining education in remote and far flung areas and other places, where regular recruitments have not been made by the State Government. In our considered opinion, the action which has been taken for appointing ad hoc teachers on academic session basis and thereafter removing them and substituting them by another set of ad hoc employees, is not in consonance with the Article 14. Thus, we find that 28 direction has been issued to continue these employees till regular selection is made. It has been held that they are not entitled for the salary of vacation period when education is not imparted. In our opinion, the decision which has been rendered, has been unnecessarily assailed by the State in these intra-court appeals. It is in their interest to continue these experienced incumbents and to replace them as early as possible by regularly selected candidates. The Single Bench has rightly placed implicit reliance in Commissioner, Kendriya Vidyalaya Sangathan & Ors. Vs. Anil Kumar Singh & Ors. (2003) 10 SCC 284 in which direction was issued by the Apex Court to continue the contractual employees till the posts are filled up by process of regular recruitment. The Single Bench has also placed reliance in Official Liquidator Vs. Dayanand & Ors. (2008) 10 SCC 1 in which the Apex Court has laid down thus- “32. In Official Liquidator Vs. Dayanand and others (2008) 10 SCC 1, the judgment in State of Haryana Vs. Piara Singh (supra) was considered in paras 18,43,46 and 48 but in the said judgment, the issue was relating to the regulations and absorption, therefore, no finding was given on the issue of replacing ad hoc employee by another ad hoc employee. The other findings have been referred in the aforesaid paras more particularly para 72 regarding inconsistency of Piara Singh (supra) of para 45 and 50 but not para 46 and held that scheme of regularisation/absorption can only be in accordance with the said Constitution Bench judgment in State of Karnataka Vs. Uma Devi (3).” Since, it has not been possible to fill the vacancies so far by appointing the persons on regular basis by the regular mode of selection prescribed under the rules or by holding the Departmental Promotion Committee, we are of the opinion that no case is made out so as to interfere in the decision rendered. However, Shri R.L. Jangid, learned Additional Advocate General has submitted that direction No.4 provides that the State Level seniority list has to be prepared and on that basis, 29 the rule of 'last come first go' has resorted to. It is submitted by the learned Additional Advocate General that for such incumbents, State Level seniority list is not maintained. It is not disputed by the counsel appearing for the respondents that the seniority list may be prepared at the Level on which the seniority of such incumbents is maintained under the rules and thereafter rule of 'last come first go' has to be applied. Accordingly, we modify the direction No.4 to the aforesaid extent. Though, we have not interfered in the order but it is desirable that ad hocism which is continuing, be stopped forthwith by way of appointing regularly selected incumbents either by promotion or by direct recruitment, as may be necessary. Let, the exercise be done for regular appointments as prayed by Shri R.L. Jangid, as early as possible, to say, within a period of six months. Accordingly, the intra-court appeals stands disposed of.
