ORDER -----
Heard learned counsel for the appellant, and perused the impugned order. The learned trial court has declined to interfere with the award of learned Arbitrator on the ground that the court has no jurisdiction to re-appreciate the material available on record, and come to different conclusion. The submissions made by learned counsel before me, are also to the effect that findings of the learned Arbitrator are wrong on merits as he has not properly appreciated the stipulations of the agreement. Suffice it to say that in view of settled legal position, such objection does not fall under Sec.34 of the Arbitration and Conciliation Act, 1996, as such, appeal has no force, and same is hereby dismissed summarily.
