In Gurwinder Singh’s case (supra In ra) upra), K.A.Najeeb’s case (supra) was not followe ollowed because in the said case ex - ase except the appellant, other co- accused had al ad already undergone trial and ergo and were sentenced to undergo imprisonment of ent of not exceeding eight years and nted rs and Hon’ble Apex Court granted bail in anticipati icipation of the impending sentence t b’s ence that the accused (K.A.Najeeb’s case) might face ht face upon conviction and also bec eady so because the accused had already served portion o tion of maximum imprisonment i.e. m trial t i.e. more than five years.
