Aggrieved by overturning of convic(cid:16)on by the Appellate Court in a case under Sec(cid:16)on 138 N.I. Act, the pe(cid:16)(cid:16)oner/complainant has come up before this Court under Sec(cid:16)on 401 CrPC, 1973.
Pe(cid:16)(cid:16)oner came before this court under Sec(cid:16)on 401 CrPC on 05.09.2024 by filing present pe(cid:16)(cid:16)on. A6er, 30.06.2024, BNSS, 2023 has subs(cid:16)tuted CrPC, 1973, as such, the pe(cid:16)(cid:16)on has to be filed under correct sec(cid:16)ons and furthermore, the exact provision of law would be Sec(cid:16)on 419(4) of BNSS. As such, pe(cid:16)(cid:16)oner under Sec(cid:16)on 401 CrPC cannot be entertained. Secondly, on the face of it, firstly a revision pe(cid:16)(cid:16)on would not lie.
Given above, the present pe(cid:16)(cid:16)on stands disposed of with liberty to file a fresh pe(cid:16)(cid:16)on or leave to appeal under the provision of correct sec(cid:16)ons. It is clarified that the (cid:16)me for which the present pe(cid:16)(cid:16)on is pending before this Court shall not be counted for the JYOTI 2024.09.11 09:33 I attest to the accuracy and integrity of this order/judgment.
