Mr. Rahul Saini, Advocate, for the petitioner Mr. Vishal Singh, AAG, Haryana --- SUMEET GOEL, J. (ORAL) 1. The substantive prayer made in the petition reads thus: ‘It is therefore most respectfully prayed that the official respondents may kindly be directed to hand over the investigation of the case bearing FIR No. 0089 dated 24.05.2017, U/s 346 IPC registered at P.S. Siwani, District Bhiwani, Haryana to some independent agency (CBI) for taking necessary, fair and impartial action.’ 2. Latest status report by way of affidavit of Aryan Chaudhary, HPS, Deputy Superintendent of Police, Siwani, District Bhiwani dated 31.7.2025 has been presented before this Court, relevant whereof reads thus: ‘3. That after registration of FIR, the investigation swung into motion and during the course of investigation carried out by ASI Uggarsain, P.S. Siwani, CIA, Bhiwani and DSP/Loharu, call details of Sandeep as well as suspected persons were obtained and analyzed. Mobile Tower Dump was also obtained and analyzed and thorough enquiry was made. During investigation, persons to whom Sandeep called on his mobile phone were joined investigation and interrogated at depth. Sachin son of Amar Singh, resident of Mithi stated that Sandeep is his friend and on 22.05.2017, ASHWANI KUMAR 2025.09.25 18:00 I attest to the accuracy and integrity of this document CRM-M No.39844 of 2019 -2- Sandeep and Manjeet son of Rishal Singh, residents of Mithi came to visit him at Hisar and Sandeep told him that he had to pay Rs. 4.5 Lacs to Manjeet and requested him to arrange ¼ days time as Manjeet was insisting him to pay the money back. Another suspect Sandeep son of Sher Singh resident of Pandwan stated that Sandeep called him on 23.05.2017 at 6:00 PM and asked to arrange Rs. 5000/- and a pair of clothes as he has to visit Jaipur. At about 10:00 PM, Sandeep came to Matani Bus Stand and took the cash and clothes, as he has to visit Jaipur. At about 10:00 PM, Sandeep came to Matani Bus Stand and took the cash and clothes. 4. That during course of investigation, polygraph test of suspected persons namely Sachin son of Amar Singh resident of Mithi, Sandeep son of Sher Singh resident of Pandwan and Manjeet son of Rishal Singh resident of Mithi was got conducted at FSL, Madhuban on 31.01.2018 and the same was found truthful. However, despite sincere and in-depth investigation conducted by the police, neither Sandeep was traced nor any clue or evidence whatsoever was found regarding his abduction either by the above named suspected persons or by someone else and hence, untraced report dated 29.04.2022 has been prepared in the case. 5. That in compliance of order dated 12.07.2022 of this Hon'ble Court and in pursuance of letter No. 14039/CR-3 dated 27.07.2022 issued by Director General of Police Haryana, a Special Investigation team (SIT) was constituted for fair and impartial investigation vide order dated 28.07.2022 which was presided over Ms. Mamta Singh, Addi. Director General of Police, Rohtak Range, Rohtak and comprising of Sh. Hitesh Yadav, HPS, Additional Superintendent of Police, Bhiwani, Inspector Kuldeep Singh, S.H.O. Police Station Siwani and Sub Inspector Murari, CIA-1, Bhiwani and further investigation in the case was carried out by Special Investigation Team. During investigation, suspected persons namely Sandeep son of Sh. Sher Singh resident of Village Dhani Behal, Sachin son of Sh. Amar Singh and Manjeet son of Sh. Rishal, both residents of Village Mithi were interrogated. 6. That during investigation colleagues of Sandeep namely Sombir son of Sh. Dhoop Singh, resident of Village Kalod, Ram Bhagat son of Sh. Ramswarup, resident of Behal, Vipin son of Sh. Gaje Singh, resident of Village Khariyawas, Manohar son of Sh. Sohan Lal, resident of Village Kikral, Naresh son of Sh. Dharampal, resident of Village Mandholi. Nanha Ram, resident of Village Devrala, Vikash son of Sh. Zile, resident of Village Mithi, Harbhaj J.. resident of Siwani were joined in investigation. 7. That during investigation friends of Sandeep namely Rajesh son of Sh. Dalip, resident of Village Mithi. Pawan son of Sh. Babu Lal. resident of Village Morka, Anil son of Sh. Rati Ram, resident of Village Bakhtawarpur. Vijay son of Sh. Mahender, resident of Village Bhojan, Krishan son of Sh. Gyani Ram, resident of Village Mithi, Surender son of Sh. Dharambir, resident of Village Matani, Bijender son of Sh. Satbir, resident of Village Mithi, Mintu son of Sh. Ran Singh, resident of Village Matani were also joined in investigation. 8. That during investigations persons acquainted with the facts of the case namely Rajesh son of Sh. Dhan Singh, resident of Village Bidhwan, Anil son of Vijay resident of Village Mithi, Sandeep son of Sh. Hoshiyar Singh, resident of Village Bhera, Sahil son of Sh. Baldev, resident of Village Gawad and Mandeep son of Sh. Balwan, resident of Village Morka were also interrogated. 9. That during investigation the persons who talked to Sandeep on his mobile phone No.9992337999 on 23.05.2017 were also joined in investigation. 10. That in search of Sandeep, letters were written to Superintendent of Police. Railway, Ambala (Haryana), Churu and Hanumangarh (Rajasthan) and all Superintends of Police in Haryana and a letter was also written to Deputy Director General of NIC to get the old backup of Call Details Record (CDR). The record from the office of Sub Divisional Officer, DHBVN Siwani (Haryana) was also obtained. Moreover, the IMEI Number of Mobile of Sandeep was put on PAN India search but no elue whatsoever of Sandeep is found. 11. That despite sincere, serious and in-depth investigation conducted by the police, neither Sandeep was traced nor any clue or evidence whatsoever was found regarding his abduction either by the above named suspected persons or by someone else. Moreover, the enquiry was also made from the present Gram Panchayat Village Mithi and other concerned villages but no clue has been found. 12. That thereafter, two members of SIT Team ie. Inspector/SHO Kuldeep Singh, Police Station Siwani, and Sub Inspector Murari No. 466/RR (546/JJR) were transferred and on this account, Sub Inspector Prem Singh ASHWANI KUMAR 2025.09.25 18:00 I attest to the accuracy and integrity of this document CRM-M No.39844 of 2019 -4- No. 325/H has been involved in the SIT Team in place SI Murari by the order no. 1523 dated 31.10.2023 passed by Sh. K.K. Rao, Addl. Director General of Police, Rohtak Range. Rohtak. Upon which, the raids were conducted in the concerned Gram Panchayats of Village Mithi and Village Matani and the enquiries were made in other nearby concerned villages also but despite best efforts, no clue has been found regarding missing person. 13. That thereafter during further investigation, one person namely Ashok son of Balwan Singh, resident of Village Mithi was joined in the investigation on 02.06.2025 and thereafter on 23.06.2025, Bijender son of Satbir and Vikas son of Zile Singh both residents of village Mithi were also joined in the investigation but despite best efforts, no clue has been found regarding missing person. The investigation is still going on and best efforts are being put in the mattor.’ 3. Having heard learned rival counsel and upon perusal of the record, it does appear that steps have been taken by the police for conducting fair/effective investigation in the matter. 4. Ergo, no further directions are required in the matter at this stage and proceedings are accordingly closed, and the petition stands

disposed of. 5.
