Learned counsel for the parties state that the matter has been compromised between the parties with the efforts of the Mediator and accordingly the matter has been rendered infructuous.
Learned counsel for the respondent submits that as per the terms and conditions of the compromise reached between the parties, the petition under Section 13 of the Hindu Marriage Act, 1955 (for short, ‘the Act’), filed by the respondent was to be converted into the petition under Section 13(b) of the Act, within 1 ½ months from the date of compromise, i.e., 14.03.2011. Learned counsel further submits that the respondent is serving in the Border Security Force and TA No.413 of 2010 2 presently posted at Kolkata and has not been able to secure leave. Therefore, he has prayed for extension of time for doing the needful.
Operative part
In view of the above fact situation, the instant transfer application is dismissed as infructuous.
However, the time for getting the petition under Section 13 of the Act converted into the petition under Section 13(b) of the Act is further extended till 25.05.2011.
