The petitioner is aggrieved by the fact that after acquittal in a criminal case, the department is proceeding against him but is not concluding the enquiry. The constitution of enquiry itself came about subsequent to disposal of writ petition in C.W.P. No.4503 of 2003 rendered by this Court on 21.01.2010 directing a reinstatement and admitting to the respondent the liberty to constitute an enquiry on the alleged misconduct attributed to him. It is submitted by the petitioner that after the decision of this Court on 21.01.2010, an enquiry officer had been appointed to conclude the enquiry within 15 days but he did not do so. Subsequently, yet another officer has been appointed, who had also not concluded the enquiry. According to him, the pendency of proceedings for two and half years after the disposal of the case by this Court constitutes extreme harassment. I do not find the delay as so C.W.P. No.9698 of 2012 -2- oppressive for a cause for intervention by this Court. The Department shall endeavour to conclude the proceedings within six months and take an appropriate decision and communicate to the petitioner in accordance with law.
