HON'BLE MR. JUSTICE AUGUSTINE GEORGE MASIH Present: Mr. Baldev Singh, Advocate, for the petitioner RANJAN GOGOI, ACJ. : (Oral) The validity of Appendix 2 of Chapter 8 of Chaudhary Charan Singh Haryana Agriculture University Act (Annexure P-3) laying down requirement of having a first division in Civil Engineering as a condition of eligibility for promotion is under challenge in the present writ petition. What should be the eligibility insofar as educational qualifications are concerned is primarily for the employer to decide. The said question essentially being one a policy, the role of the courts in such matters would be minimum. No case of hostile discrimination or violation of Article 14 of the Constitution of India does arise in the facts noted above. The writ petition is, therefore, not being entertained as no substantial issue C.W.P. No. 375 of 2011 2 with regard to the vires or the validity of the above said Act is made out. Dismissed.
