(ORAL) In this appeal, order dated 25.11.2008 passed by the Commissioner under the Workmen’s Compensation Act, 1923 has been assailed whereby the appellants were directed to deposit Rs.2,35,530/- in the Court of Commissioner within 30 days failing which they were held liable to pay simple interest @ 12% per annum on the aforesaid amount from the date of order till its realization and appellants being Principal were ordered to be indemnified by the contractor. Learned counsel for the appellants submits that since the contractor has not indemnified the appellants, therefore, the present appeal has been filed. He further submits that in view of the communication letter date 20.10.2009 by the Contractor addressed to the AO (Cash), O/o General Manager Telecom District, Bharat Sanchar FAO No.33 of 2009 (O&M) -2- Nigam Limited, Sonepat, the Contractor has indemnified the appellants. He further submits that there is no grievance left on the part of the appellants for the purpose of redressal by this Court. Thus, he prays for withdrawal of the appeal.
