The pe""oner, apprehending arrest in the FIR cap"oned above, has come up before this Court under Sec"on 438 CrPC.
Vide order dated 13.06.2024, this Court had granted interim an"cipatory bail to the pe""oner and the said order is con"nuing "ll date.
Facts of the case are being taken from short reply dated 03.08.2024 filed by Assistant Commissioner of Police which reads as follows:-
The factual matrix of the ma(cid:17)er is that the complainant namely Ijjat Rai Walia filed a complaint bearing No. 267/Peshi dated 03.05.2024 to the office of Commissioner of Police, Jalandhar; wherein, the complainant stated that Akash Kumar (present pe33oner) was employed at Makkar Motors Pvt. Ltd., GT Road, Paragpur, Jalandhar" for more than two months in the capacity of a night security guard at the adjoining stock yard. His engagement was facilitated through the security company, Safe Detec3ve (India), owned by Dinesh, whose mobile number is 8054952882. The complainant has been receiving numerous complaints from workshop customers indica3ng that accessory items and personal belongings have been reported as missing and stolen from their vehicles, which were entrusted for repair at Makkar Motors, Paragpur, Jalandhar. Jyoti Sharma 2024.08.13 10:11 I attest to the accuracy and authenticity of this order/judgment High Court, Sector 1, Chandigarh 1 CRM-M No. 29789 of 2024 The complainant further stated that the complainant ini3ated an enquiry at his own level and he suspected the involvement of the present pe33oner and on Moner the morning of 30th of last month, the complainant contacted the Police by dialing the Helpline number 100 and subsequently, the Police officials of Police post at Paragpur arrived, conducted preliminary ques3oning, and instructed the complainant to submit a formal complaint, which was duly handed over to SHO. The complainant is apprehensive that addi3onal cases of theB may emerge in the near future and therefore, the complainant requested to take legal ac3on against the present pe33oner and efforts may be made to recover the stolen items and personal belongings.
Counsel for the pe""oner submits that the pe""oner has been falsely implicated in the case and has clean antecedents and is a student of 10+1. There is nothing on record to connect him with the commission of alleged offence of theD.
State counsel submits that the pe""oner has joined the inves"ga"on and is not required for any further inves"ga"on.
