ORDER:

Challenge in this petition is to demand of cess from the petitioner under the provisions of the Building & other Construction Workers Welfare Cess Act, 1996. Learned counsel for the petitioner states that representation dated 24.8.2009, Annexure P-5, is pending before the competent authority i.e. respondent No.4 and it will be appropriate that the said authority takes a decision thereon in the first instance. CWP No.4398 of 2010 2 Without expressing any opinion on merits, this petition is disposed of with a direction that respondent No.4 may take decision on the representation of the petitioner in accordance with law within three months from the date of receipt of a copy of this order.
