Khurana, Advocate, for the petitioner. * * * SATISH KUMAR MITTAL , J. ( Oral ) In the instant writ petition, the petitioner is challenging the order dated 18.11.2008 (Annexure P-1), passed by the Competent Authority -cum- Executive Engineer, Construction Division No.3, PWD B&R Branch, Ferozepur. This order was passed under Section 143 (2) of Chapter 14 of the Punjab Regional Town Planning & Development Act, 1995, whereby the order of demolition of the shop of the petitioner has been issued. Such an order is appealable under Section 145 of the said Act. However, the petitioner has not availed the remedy of appeal. In view of the aforesaid facts, learned counsel states that the petitioner may be permitted to withdraw this petition with liberty to avail CWP No. 18613 of 2011 -2- the aforesaid remedy of appeal in accordance with law. Dismissed as withdrawn with the aforesaid liberty. If the petitioner files the appeal under the aforesaid provision within a period of one month from today, the Appellate Authority shall decide the same on merits.
