CORAM: Hon’ble Mr.Justice Jasbir Singh Hon’ble Mr.Justice Gurdev Singh Present: Mr.Nand Lal Sammi, Advocate for the petitioner Jasbir Singh, J. (Oral) This writ petition has been filed to lay challenge to the notifications issued under Sections 4 and 6 of the Land Acquisition Act, 1894 (in short, the Act) on 02.05.2001 and 30.4.2002, respectively. We are sure that in view of mandatory provisions of the Act, by now award might have been passed, may be in the year 2004-2005. It is stated by counsel for the petitioner that above said notifications are under challenge in this Court. To say so, reference has been made to CWP No.13948 of 2002. We are of the opinion that in view of delay in filing this writ petition, pendency of other writ petition is no ground to entertain request of the petitioner. Petitioner continued to sleep and has woken up only when the acquisition proceedings had become final. In view of judgments of the Hon’ble Supreme Court in Star Wire (India) Ltd. v. State of Haryana, (1996) 11 SCC 698; Municipal Civil Writ Petition No.18830 of 2010 2 Council Ahmednagar v. Shah Hyder Beig, (2000) 2 SCC 48; C. Padma v. Dy. Secretary to the Government of Tamil Nadu, (1997) 2 SCC 627; M/s Swaika Properties Pvt. Ltd. v. State of Rajasthan, JT 2008 (2) SC 280 and Swaranlata v. State of Haryana and others, AIR 2010 SC 1664, possibly, this writ petition cannot be entertained. ` Accordingly, the writ petition stands dismissed. (Jasbir Singh) Judge
