version in the FIR reads as under :7 (cid:1)To, Incharge Officer, Police Station Shahzadpur, Jai Hind, Today on 26.03.2025, Me SI along with ASI Rajbir Singh No. 24, EHC Jagpal Singh No. 922, EHC Tajinder Singh No. 1314, constable Shekhar Rana No. 1526, in uniform, in a private vehicle with laptop, printer, electronic weighing scale and investigation bag etc., went on patrol and investigation of crime, at around 11:30 AM, from CIA staff Shahzadpur, district Anuradha 2025.06.20 07:39 I attest to the accuracy and integrity of this document (cid:24) Ambala, passing through town Shahzadpur, was present at Shahzadpur near Panchkula Yamuna Nagar Highway bridge at around 11:50 AM, when a special informer met the SI and informed that Nitin resident of village Shahpur Naraingarh is involved in drug consumption and selling drugs, who is even today available to sell drug capsules to someone known to him. He is roaming around the nearby ITI Shahzadpur. He is wearing a green checkered shirt and grey lower. If an immediate raid is conducted, Nitin can be caught along with the above3mentioned drug capsules. The information is strong and trustworthy; information about the situation was sent to Incharge officer of police station Shahzadpur through constable Shekhar Rana no. 1526 of police station Shahzadpur by an information letter and Me SI prepared a separate notice under section 42 NDPS Act and sent it through ASI Rajbir Singh no. 24 of DSP Naraingarh

to inform Mr. Suraj Chawla HPS DSP Naraingarh about the situation. Thereafter, Me SI informed the passersby about the situation and told them about joining the raiding party, on which all the people left the spot citing their legitimate compulsions. On this Me SI along with fellow employee and special informant reached the nearby ITI Shahzadpur where the special informant pointed out that the boy standing in a green checkered shirt and grey lower is Nitin. The special informant was freed. Me SI informed the passersby about joining raiding party and told them about the situation on which all the people told their legitimate compulsions and left the spot. Me SI with the help of fellow employee caught the boy standing in front of Champa Garden nearby. Me SI asked his name and address and on enquiry he told his name as Nitin son of Amarjeet resident of village Shahpur police station Naraingarh district Ambala. At the same time constable Shekhar Rana no. 1526 from police station Shahzadpur came to the spot after giving information letter. After this, Me SI told the above mentioned Nitin that I suspect you to have narcotic capsules. You have the legal right Anuradha 2025.06.20 07:39 I attest to the accuracy and integrity of this document (cid:27) to get yourself searched in front of a magistrate or a gazetted officer and he can be called on the spot, on which a notice was prepared under section 50 NDPS Act. The notice was signed by witnesses. The notice was read out and explained to accused Nitin, on which accused Nitin expressed his consent that I want my search to be done in front of a gazetted officer and accused Nitin signed the notice. After this, at around 12:20 PM, Me SI called Mr. Alamgir Naib Tehsildar Mullana District Ambala on his mobile phone number 8307273705 from my mobile phone number 9416175024 and requested him to reach the spot after explaining the situation. At around 01:25 PM, Shri Alamgir Naib Tehsildar Mullana District Ambala arrived at the spot along with his staff, Me SI, after explaining the situation to him, presented before him the notice under section 50 of the NDPS Act and the above3mentioned person Nitin. Shri Alamgir, Naib Tehsildar Mullana, District Ambala seen the notice under section 50 of the NDPS Act and Shri Alamgir, Naib Tehsildar Mullana, District Ambala, in relation to the information given, carried out the personal search of the employees included in the raiding party as per the law. No objectionable thing was recovered from all the employees other than the everyday items. On which a separate report of personal search and recovery was prepared. On which the witnesses put their signatures. Shri Alamgir Naib Tehsildar Mullana District Ambala, after revealing his identity to the above mentioned Nitin, instructed Me SI to search the above mentioned Nitin in his presence, upon which Me SI carried out the search of Nitin as per the procedure, on searching Nitin, 60 packets of narcotic capsules, 8 capsules per packet, total 480 narcotic capsules, on which Dicyclomine Hydrochloride Tramadol Hydrochloride Acetaminophen Capsules SPAS Parvion Plus B.ΝΟ. C3240510 Mfg May 2024, Exp. April 2026 is written, were recovered from a black coloured polythene bag held in his hand, the above mentioned Nitin could not produce any license or permit Anuradha 2025.06.20 07:39 I attest to the accuracy and integrity of this document (cid:25) regarding the pure narcotic capsules recovered from him. When the recovered capsules were weighed with a weighing scale brought along, the weight of one capsule was 0.55 gram and after taking out from wrapper and weighing 8 capsules, it was 4.42 grams and the weight of 8 capsules with wrapper was 5.86 grams. The total weight of the recovered 480 capsules without wrapper was 264 grams and the weight of 60 stripes (480) capsules with wrapper was 351 grams. The opinion of the Drugs Controller Officer, Ambala is to be taken regarding the recovered capsules, for which Shri Hemant Grover, Drugs Controller Officer, Ambala was contacted on his mobile phone no. 9416404474. Who said that you should send the application and the photographs of the seized capsules through WhatsApp to my mobile phone, on which a separate written application for seeking opinion about the capsules and photographs of the strips of the narcotic capsules were sent to the mobile phone of the Drugs Controller Officer, Ambala, after some time the Drugs Controller Officer, Ambala sent his report about the above narcotic capsules, a printout of which was taken and kept, the report sent by the Drugs Controller Officer is as follows: Opinion3The above Mentioned Drug as per label claim contains "Tramadol" which falls under NDPS Category at Sr. No. "238 ZH" of table in NDPS Act. Above mentioned recovered total of 480 narcotic capsules were put in the same polythene and then put in a separate cloth bag and prepared recovery, the bag was stamped by Me SI with NK/3 seal and a sample seal was prepared separately. Shri Alamgir, Naib Tehsildar, Mullana, District Ambala, stamped the recovery parcel narcotic capsules by putting his AG/1 seal and put his seal on the sample seal. The case property narcotic capsules and sample seal were attested by Shri Alamgir, Naib Tehsildar, Mullana, District Ambala. He kept the seal with himself for later use. Me SI kept my seal with myself for later use. The recovered goods, case property narcotic capsules and sample seal were taken into police possession as Anuradha 2025.06.20 07:39 I attest to the accuracy and integrity of this document (cid:21) evidence through property seizure memo. The witnesses and the accused signed on the property seizure memo and Shri Alamgir, Naib Tehsildar Mullana, district Ambala attested the property seizure memo That the above accused Nitin has committed the offence under section 22361385 of NDPS Act by keeping the above mentioned 480 narcotic capsules in his possession without licence or permit. For which a written complaint has been written and the constable Shekhar Rana no. 1526 is being sent to Shahzadpur police station for registration of FIR. After that, inform about the registered FIR number and copies of the First Information Report should be sent as special report to the service of Higher Officials and Incharge CIA Staff Shahzadpur was informed to send second investigation officer to the spot for further investigation. Today Police Station 3 Upon receipt of the above iinformation in the police station from constable Shekhar Rana no. 1526, FIR no. 34 dated 26.03.2025 under section 22361385 NDPS Act was registered at Shahzadpur Police Station and the copy FIR along with the original complaint was sent to investigator through constable Shekhar no. 1526. Copies of the copy FIR are being sent in the service of Higher officials by e3 mail as a special report. The Incharge officer was informed about the situation. Learned counsel for the petitioner has argued that the petitioner has been falsely implicated in the present case on the basis of the disclosure statement suffered by co7accused Nitin from whom the Anuradha 2025.06.20 07:39 I attest to the accuracy and integrity of this document 5 alleged recovery of contraband was made and the co7accused has stated the petitioner to be the supplier of the said contraband. Learned counsel for the petitioner undertakes that the petitioner is ready and willing to join the investigation and cooperate with the investigating officer. Notice of motion. accused persons charged under Section 29 of the NDPS Act to claim that they were not present at the site of recovery and had no conscious possession of the contraband. Such assertions are often used as a defence to secure bail. However, this line of argument needs to be carefully examined, as those implicated under Section 29 are frequently the principal architects behind the drug trafficking operations. They manage and direct the illicit trade from behind the scenes, while deploying others who are eventually caught with the contraband as mere instruments of their broader criminal enterprise. In view of this, the Court firmly holds that the absence of direct recovery from such accused cannot be a ground for leniency, and they must be treated with equal seriousness and accountability as those found in possession. 5. (cid:12)!2/!3 In view of the foregoing analysis and considering the modus operandi typically employed by masterminds involved in illegal narcotic activities, it is imperative that such conduct be addressed with firm determination and strict legal measures. The legislative intent and the integrity of the legal system must be preserved without compromise, irrespective of the fact that no recovery was made. Anuradha 2025.06.20 07:39 I attest to the accuracy and integrity of this document 6 Given the specific facts and circumstances of the case, as well as the nature of the allegations levelled against the petitioner, marked by his involvement in another case in similar nature, this Court is not inclined to grant the relief of anticipatory bail at this stage, hence, the same is hereby dismissed. It is, however, clarified that the observations made herein are solely for the purpose of adjudicating the present bail application and shall not influence the trial court in any manner while deciding the case on its merits and in accordance with law.
