By this order, I dispose of the above mentioned four petitions arising out of the same FIR. 2. All the petitions have been filed praying for the grant of regular bail to the petitioners in case bearing FIR No.126, dated 29.08.2024, under Sections 109, 111, 61(2), 62, 49, 351(2), 351(3) of BNS and Sections 25, 27 of Arms Act, registered at Police Station City Gurdaspur, District Gurdaspur. 3. Succinctly the facts of the case are that FIR in the present case was got registered on the statement of complainant, namely, Nakul Mahajan. It was alleged that on 15.03.2022 at about 10:30 P.M., Lovepreet Singh @ Lavi was extending extortion calls to the complainant and demanded ransom. In this regard, the complainant lodged the case bearing FIR No.177, dated 03.08.2022, under Sections 385, 387 of IPC. However, it was alleged that on the intervening night of 28/29.08.2024, the complainant was at home and when, he was going to sleep, he heard sound of 03 fire shots and then, at about 02:07 A.M., he received a whatsapp call from unknown number, i.e. +4917611618307, however, he RITTU 2025.11.27 17:38 I attest to the accuracy and integrity of this document CRM-M No.21772 of 2025; CRM-M No.21775 of 2025; CRM-M No.22437 of 2025 (O&M); CRM-M No.23686 of 2025 -3- did not attend the same. It was alleged that at about 05:00 A.M., when the complainant came out, then he saw 03 empty shell and 02 live cartridges lying on the main gate of his house. There were bullet marks on the wall and roof of his house. It was alleged that Lovepreet Singh @ Lavi had already extending threats to him and the same was executed by him through his accomplices. It was alleged that the discord was with Simranjit Singh @ Sab, who previously got registered one case against him. It was alleged that wife of Lovepreet Singh @ Lavi, namely, Mandeep Kaur and brother-in-law, namely, Jyot are actually involved in the incident and thus, the request was made to take legal action against the accused. On registration of the FIR, the investigation commenced. During the investigation, complicity of the petitioners surfaced and thus, they were arrayed as an accused in the present case. Resultantly, the petitioners were arrested on 11.09.2024, 14.10.2024, 23.09.2024 & 29.09.2024, respectively. However on completion of the investigation, the challan was presented and on framing of charges, the trial commenced. The petitioners approached the Court of learned Additional Sessions Judge, Gurdaspur praying for the grant of bail, however after hearing both the sides and finding no merit in the same, the learned Additional Sessions Judge, Gurdaspur declined the bail applications filed by all the petitioners vide orders dated 13.03.2025, 19.02.2025, 02.04.2025 & 28.10.2024, respectively. Hence being aggrieved, the petitioners are before this Court by way of filing the present petitions praying for the grant of regular bail. 4. Learned Senior counsel for the petitioners have vehemently RITTU 2025.11.27 17:38 I attest to the accuracy and integrity of this document CRM-M No.21772 of 2025; CRM-M No.21775 of 2025; CRM-M No.22437 of 2025 (O&M); CRM-M No.23686 of 2025 -4- contended that the petitioners have been falsely implicated in the present case. They have submitted that from the bare reading of the allegations made in the FIR, it is apparent that the specific allegations are against Lovepreet Singh @ Lavi and his family members and one Simranjit Singh @ Sab. They have submitted that during the investigation, wife and brother-in-law of Lovepreet Singh @ Lavi, namely, Mandeep Kaur and Jyot have been declared innocent. They have submitted that the petitioners were not even named in the FIR. To buttress their arguments, they have submitted that the petitioners have no criminal antecedents as they have never been involved in any other case. They have submitted that the petitioners are behind bars since the date of their arrest and thus, have suffered incarceration of more than 01 year. They have submitted that the complainant already stands examined and thus, in the facts and circumstances, the petitioners deserve to be granted bail. 5. Per contra, learned counsel for the State however has vehemently opposed the submissions made by learned counsels for the petitioners. He has submitted that the petitioners in conspiracy with Lovepreet Singh @ Lavi had carried out the attack on the house of the complainant. He has submitted that the CCTV footage was verified by the Investigating Agencies and thus, the complicity of the petitioners prima facie established. He, on instructions, has submitted that out of total 19 prosecution witnesses, only the complainant has been examined. He has produced custody certificates of all the petitioners today in the Court, which are taken on record. The Court has heard learned counsel for the parties and perused the record with their able assistance. 7. On hearing learned counsel for the parties and perusing the record, it is deciphered that the petitioners though were not named in the FIR, however they have been arrayed as an accused in the present case during the investigation. The persons, who were named in the FIR, i.e. Mandeep Kaur and Jyot were declared innocent during the investigation. Custody certificates produced would show that the petitioner, namely, Lovedeep Singh @ Love (in CRM-M-21772-2025) has suffered incarceration of 01 year, 02 months and 12 days; petitioner, namely, Bikramjit Singh @ Bikka (in CRM-M-21775-2025) has suffered incarceration of 01 year, 01 month and 06 days; petitioner, namely, Sahil (in CRM-M-22437-2025) has suffered incarceration of 01 year, 01 month and 26 days and the petitioner, namely, Sahil @ Kalu (in CRM-M-23686- 2025) has suffered incarceration of 01 year, 01 month and 25 days as on 25.11.2025. It further reflects that the petitioners are not involved in any other case. Only the complainant has been examined, out of total 19 prosecution witnesses. 8. The veracity of the allegations would be assessed only after the conclusion of the trial and on the appreciation of evidence to be led by both the parties before the trial Court. 9. This Court would refrain itself from commenting anything on the merits of the case. Accordingly, all the petitions are allowed and the petitioners, namely, Lovedeep Singh @ Love, Bikramjit Singh @ Bikka, Sahil and Sahil @ Kalu are ordered to be released on bail on their furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate.
