(Oral) The petitioner, who has retired as Store Verifier from the office of Chief Engineer, UHBVN, Panchkula on 30.9.2007 on attaining the age of superannuation, has filed the instant petition for quashing the letter dated
9.1.2008 (Annexure P5), whereby an amount of Rs.1,97,740/- has been ordered to be recovered from the petitioner. In the petition, it has been alleged that for the said amount neither any show cause notice was issued to him nor any departmental inquiry was held. In this regard, counsel for the petitioner referred to the information received by the petitioner under the Right to Information Act, 2005, copy of which has been annexed with the petition as Annexure P9, wherein it has been disclosed that in this regard no responsibility of any official has been fixed by any authority. C.W.P. No.16341 of 2008 -2- In the written statement filed by the respondents, the aforesaid fact has not been disputed. In view of this fact, counsel for the respondents fairly states that the department will hold an inquiry and if the petitioner is found to be responsible, then the said amount amount will be recovered from him. In view of the aforesaid statement made by the counsel for the respondents, counsel for the petitioner does not want to press this petition. Dismissed as not pressed.
