In respect of detained goods the Assistant Excise & Taxation Commissioner (Mobile Wing) Amritsar has passed an order on 15.7.2009 imposing penalty. The aforesaid order is an appealable order with further remedy before the Tribunal. Accordingly, the petitioner may avail the remedy as provided by laws. The writ petition is rendered infructuous and is disposed of as such. However, it is made clear that the petitioner shall be at liberty to raise all the issues raised in the instant petition before the appellate authority as well as before the Tribunal.
