(ORAL) The petitioners, who are residents of Village Bedwa, Tehsil Meham, District Rohtak and who made a complaint against the Sarpanch of Gram Panchayat of Village Bedwa, i.e., respondent No.4, have filed this petition under Article 226 of the Constitution of India for issuing directions to the respondents to initiate action against the said respondent. In the written statement filed on behalf of respondents No.1 to 3, it has been disclosed that on the complaint of the petitioners, the matter was enquired into and two allegations, though stand proved, but the Deputy Commissioner vide order dated 1.1.2008 has exonerated respondent No.4 by getting deposited from her an amount of Rs.19,600/- with a warning. In view of the aforesaid fact, counsel for the petitioners states C.W.P. No.12588 of 2008 -2- that the petitioners may be permitted to withdraw this petition with liberty to challenge that order by filing an appeal under Section 51(5) of the Haryana Panchayati Raj Act, 1994 or by making a representation to the Government. Dismissed as withdrawn with the aforesaid liberty. If any such appeal/representation is filed to the Government, the same will be considered in accordance with law, expeditiously.
