No. 16847 of 2006 [2] The question raised in this petition is whether the vacancy meant for direct recruit prior to the enforcement of the Rules could be filled up in accordance with the Rules or have to be filled up on the basis of the earlier instructions or Rules. It is admitted case of the petitioner that the vacancies which have arisen prior to 2003 meant for direct recruit are sought to be filed up in accordance with the qualification laid down in Electricity Act, 2003, which have been amended by notification dated September 13, 2006. It is well settled that the direct vacancy to be filled up by direct recruitment have to be filled up in accordance with the prevalent Rules on the date of filling up of the vacancy rather than in accordance with the old Rules.
