( Oral ) The petitioners, who are the elected Panches of Gram Panchayat Village Baroli, Tehsil and District Panipat, have filed this petition under Article 226 of the Constitution of India for issuing direction to respondents No.1 to 3 to take appropriate action against Sarpanch of the Gram Panchayat (respondent No.4 herein) under Section 51 of the Haryana Panchayati Raj Act, 1994. Written statement on behalf of respondent No.4 has been filed in Court today. The same is taken on record and its copy has been handed CWP No. 11865 of 2008 -2- over to counsel for the petitioners. In the written statement, filed on behalf of respondent No.3, it has been disclosed that on the complaint of the petitioners, the matter was enquired into and enquiry report was submitted by respondent No.3 to the Deputy Commissioner, Panipat. Undisputedly, till date, the Deputy Commissioner, Panipat has not taken any final decision on the said enquiry report. Therefore, after hearing counsel for the parties, we dispose of this writ petition with a direction to the Deputy Commissioner, Panipat (respondent No.2 herein) to consider the enquiry report submitted by respondent No.3 and to take a final decision on the same within a period of three months from today, in accordance with law after providing opportunity of hearing to respondent No.4.
