CORAM:- HON'BLE MR. JUSTICE RAJAN GUPTA Present: Mr.H.S. Baath, Advocate for the petitioner Mr.Shilesh Gupta, DAG, Punjab .. RAJAN GUPTA, J.: (Oral) This is a petition under section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner under sections 420,465,467,468,471,120-B IPC vide FIR No.48 dated 2.3.2010 at police station Model Town, Ludhiana City. Learned counsel for the petitioner contends that petitioner has been in custody since 14.12.2010, investigation of the case qua petitioner has been completed and challan presented before the competent court of jurisdiction. According to him, the only allegation against the petitioner is that he is a marginal witness to a power of attorney on the basis of which sale deed was executed. He submits that no useful purpose would be served by detaining the petitioner in custody any longer. Crl. Misc. No.M-3886 of 2011 -2- Learned State counsel has opposed the prayer for bail on the ground that allegations against the petitioner are serious. He, on instructions from ASI-Harsukhdev Pal who is present in court, does not dispute the fact that investigation qua the petitioner has been completed. Keeping in view the aforesaid contentions, period of incarceration of petitioner and the fact that trial may still take some time to conclude, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner.
