(Oral): Present petition has been filed under Section 439 Cr.P.C. for the grant of regular bail to the petitioner in case FIR No.508 dated
14.12.2010, registered at Police Station Sadar Bahadurgarh, District Jhajjar, under Sections 420, 467, 468, 471, 201, 120-B IPC. Case of the prosecution is that the petitioner projected himself as Managing Director of Bharat Oil & Gas Company and duped the complainant of a sum of Rs.5.00 lacs for allotment of a gas agency. Counsel for the State submits that numerous FIRs have been registered against the petitioner. Shri G.S. Punia, Counsel appearing for the petitioner, submits that on similar allegations, different Coordinate Benches of this Court have granted bail to the petitioner by taking into consideration the period of custody and the fact that the case is triable by the court of Magistrate. Counsel for the petitioner has referred to order Annexure P-4 passed in Crl. Misc. No.M-1638 of 2011 on 4.4.2011 and the orders passed in Crl. Misc-M Nos.19998 and 19999 of 2011, passed on 19.10.2011. Admittedly, this is a case of magisterial trial. The petitioner is stated to be in custody since 15.12.2010. Trial will take a long time to conclude. Hence, further detention of the petitioner is not warranted. He is ordered to be released on bail to the satisfaction of Chief Judicial Magistrate, Jhajjar.
