(ORAL) This is a petition under Section 482 Cr.P.C for quashing of charge and charge sheet framed against the petitioner and Rajinder Singh in the case titled as State vs. Rajinder Singh etc. arising out of FIR No.95 dated 06.07.2005 of Police Station Mahilpur, District Hoshiarpur under Sections 302/34/120-B IPC. On December 03,2010, the following order was passed :

Learned counsel for the petitioner seeks some time to place on record copy of order passed under Section 319 Cr.P.C., whereby, the petitioner has been summoned as an additional accused to face trial. Adjourned to 21.12.2010.

Thereafter, learned counsel for the petitioner took time on

21.12.2010 to comply with the order dated 03.12.2010. Accordingly, the case was adjourned to 10.01.2011. On 10.01.2011, the order was still not Crl. Misc. No.M-35562 of 2010 2 complied with and more time was prayed for. Accordingly, the matter was adjourned for today with the following observations ; “ In case, the order dated 03.12.2010 is not complied with on the next date of hearing, the present petition shall be deemed to have been dismissed.” Today, neither anyone is present on behalf of the petitioner nor the copy of the order passed under Section 319 Cr.P.C, whereby, the petitioner was summoned as an additional accused to face trial, has been placed on record. Dismissed in view of the order already passed on 10.01.2011.
