CORAM: HON'BLE MR.JUSTICE RAM CHAND GUPTA Present: Mr.Rajesh K.Kataria, Advocate for the petitioner Mr.Amandeep Singh, AAG, Haryana *** Ram Chand Gupta, J.(Oral) The present petition has been filed by petitioner Vikas alias Vicky under Section 439 Cr.P.C. seeking regular bail in case FIR No. 189 dated 12.6.2009 registered under Sections 395, 412, 120-B IPC and Section 25 of the Arms Act at Police Station Sadar Gohana, District Sonepat. I have heard learned counsel for the parties and have gone through the whole record carefully including the impugned order passed by learned Additional Sessions Judge, Sonepat, vide which the application for regular bail of the petitioner was dismissed. Briefly stated that on 11.6.2009, complainant started his journey from Ambala with two tractors attached to each other and at about
11.55 PM, when he reached near village Chidana, three persons came on a motorcycle and made the complainant to stop his vehicle. Two of them had taken the complainant on one side while third person fled away with the tractors towards Panipat. The other two persons accompanying the CRM No.M 32920 of 2010 -2- complainant tied him and thereafter, they also fled away from the spot on their motorcycle. They had also taken away his mobile phone. Supplementary statement of the complainant was also recorded. During investigation, petitioner -accused was caught red handed while driving away the looted tractor. A pistol was also recovered from his possession. Mobile phone of the complainant was also recovered from his possession. It has been contended by learned counsel for the petitioner that he has been continuing in custody since 7.7.2009 and that the trial is not likely to be concluded in near future. These types of incidents are increasing these days. Hence, in view of serious allegations against the petitioner-accused, he is not entitled for bail at this stage. Hence, without expressing any opinion on merits of the case, the present petition filed by petitioner Vikas alias Vicky is dismissed being devoid of any merit at this stage.
