This petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No.735 dated 7.10.2009, under Sections 420/34 of the Indian Penal Code at Police Station Kotwali Bathinda. While issuing notice of motion, the following order was passed by this Court on 1.12.2009:-
Learned counsel states that as per his instructions received today, the parties have arrived at an out-of-court settlement. In support of that averment, he has placed on record a true translated copy of the compromise, along with vernacular copy thereof, duly attested by Notary District Courts, Bathinda. Notice of motion to the Advocate General, Punjab for 18.1.2010. Criminal Misc. No.M- 33698 of 2009 (O&M) -2- In the meanwhile, it is directed that in the event of arrest of the petitioner by the arresting officer, he shall be released on bail subject to the following conditions:- (i) that he shall make themselves available for interrogation by a police officer as and when required; (ii) that he shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) that he shall not leave India without the previous permission of the Court.
Learned State counsel, on instructions from HC Satpal Singh, has submitted that the petitioner has joined investigation in terms of the order reproduced above and is not required for further investigation. Accordingly, without expressing any opinion on the merits of the case, this petition is allowed and the order granting interim bail dated 1.12.2009 is made absolute. July 28, 2010 (SABINA) JUDGE
