RAM CHAND GUPTA, J.(Oral) Crl.M.No.6515 of 2012 Application is allowed subject to all just exceptions. Crl.M.No.M-3062 of 2012 The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.124, dated 1.3.2022, under Sections 279, 337, 304-A IPC, registered at Police Station Sector 17, Chandigarh. I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by learned Additional Sessions Judge, Chandigarh, vide which application filed on behalf of the present petitioner for anticipatory bail was dismissed. Briefly stated, petitioner was facing trial before learned trial Court. He was released on bail. However, he absented on 6.12.2005 and, thereafter he was declared proclaimed offender vide order dated 7.12.2007 and since then he has been absconding. Crl.M.No.M-3062 of 2012(O&M) -2- It has been contended by learned counsel for the petitioner that he did not appear before the Court as he was told by his lawyer that he has been acquitted by the Court. However, plea cannot be accepted. No action was taken by the present petitioner against the said lawyer. Only vague plea has been taken in this regard. Hence, it is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioner-accused. Without expressing any opinion on the merits of the case, the present petition filed by petitioner-Jagjit Singh for grant of anticipatory bail is, hereby, dismissed being devoid of any merit.
