Judgment

HON'BLE MR.JUSTICE RAMESHWAR SINGH MALIK

Operative part

1.

Whether Reporters of local papers may be allowed to see the judgement? 2. To be referred to the Reporters or not? 3. Whether the judgment should be reported in the Digest? Present: Mr.Pritam Saini, Advocate for the petitioner *** RAMESHWAR SINGH MALIK J.(ORAL): CRM No.54272 of 2012 Application seeking exemption from filing of certified copies of Annexure P-1 and P-2 is allowed subject to all just exceptions. Criminal misc.application stands disposed of. Criminal Misc.M-No.30402 of 2011 During the course of arguments, when confronted with the judgment of Hon'ble the Supreme Court in the case of Sakiri Vasu State of U.P. and others 2008(2) SCC 409, learned counsel for the petitioner very fairly states that let this petition be allowed to be withdrawn, with liberty to avail the alternative remedy in terms of law laid down by Hon'ble the Supreme Court in Sakiri Vasu's case (supra). In view of the statement made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as Criminal Misc.M-No.30402 of 2011 2 prayed for. However, lest this order is misunderstood, it is made clear that as and when the petitioner moves an appropriate representation to the authorities concerned, under Chapter XII of the Code of Criminal Procedure, 1973, the same shall be considered, dispassionately and expeditiously, as warranted by law, intimating the result thereof to the petitioner, as well. With the observations made above, the present petition is disposed of.
