CORAM:- HON'BLE MR. JUSTICE GURDEV SINGH Present:- Mr. B.S.Jaswal, Advocate, for the petitioner. Gurdev Singh, J (oral) Heard. This petition, under Section 482 of the Code of Criminal Procedure invoking the inherent jurisdiction of this Court, has been filed by Charanjit Kaur-petitioner for directing the respondents to proceed with the complaint/representation dated 20.8.2009 (Annexure P-1) and decide the same within a stipulated period and for a direction to handover the enquiry/investigation to some higher Police Officer. Reply has been filed by the respondents, in which they admitted the receipt of the said complaint/representation. They have stated therein that the complaint was enquired into and finding no truth, the same was ordered to be consigned. After that finding was recorded on that complaint/representation, no such direction, as prayed for in the petition, can be issued. The petitioner is not without remedy after such a finding has been recorded and she can file a private complaint before the trial Court Crl. Misc. No. M – 31575 of 2009 -2- under Section 200 Cr.P.C or she can move a petition under Section 156(3) Cr.P.C. The petitioner has made another prayer in the petition to protect her own life and liberty and that of her family members. No such prayer was made by her in the representation made by her to the DSP.
