HON’BLE MR. JUSTICE AJAI LAMBA PRESENT: - Mr. R.S. Mamli, Advocate, for the petitioner. . . . AJAI LAMBA, J (Oral) This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.255 dated 17.11.2007 lodged for offences under Section(s) 166, 167, 218, 420, 467, 468, 471, 120-B IPC with Police Station, Ding, District Sirsa. Perusal of the order of Sessions Judge, Fatehabad indicates that the petitioner identified a person as Kashmir Kaur as having signed an affidavit sworn on 7.4.2007. On the basis of the affidavit filed before the revenue authorities, mutation has been sanctioned. Allegation in the FIR is that the Will of Chanan Singh was forged and the persons who were rightful owners, have been deprived of the property. Crl. Misc. No. M-32596 of 2008 [2] It seems that some other person signed as Kashmir Kaur who has been identified by the petitioner as Kashmir Kaur, the petitioner being Municipal Councillor in Fatehabad. Since impersonation is involved, only custodial interrogation of the petitioner shall disclose as to who had signed the affidavit as Kashmir Kaur. The petition is dismissed.
