Dadwal, Advocate for respondent no.2. *** JASWANT SINGH, J.(ORAL) Prayer is under section 482 Cr.PC for quashing of FIR No.40 dated 14.8.2010 under Sections 323, 324, 325, 452, 148 and 149 of IPC registered with Police Station Behram, District Shaheed Bhagat Singh Nagar as well as all consequential proceedings on the basis of compromise in the shape of affidavit Annexure P-2 arrived at between the parties. Learned counsel for the petitioners points out that on the basis of compromise parties were given liberty to appear before the learned Illaqa Magistrate and get their statements recorded in terms of compromise. However, the same could not be done as the complainant has since flown to Crl. Misc. No.M 29667 of 2010 # 2# United Kingdom on a work permit. Learned counsel for the complainant also states that though compromise has been effected but the statements could not be recorded since the complainant has gone to United Kingdom. In view of such a situation, learned counsel for the petitioner prays for withdrawal of the petition with permission to file afresh as and when the complainant is available.
