Judgment

CORAM :- HON'BLE MR. JUSTICE SATISH KUMAR MITTAL Present: Mr. H.S. Batth, Advocate, for the petitioner. Mr. N.S. Gill, AAG, Punjab. * * * Petitioner Gurinderjit Singh has filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 47 dated 11.3.2006 under Section 420 IPC, registered at Police Station Qilla Lal Singh, Police District Batala, District Gurdaspur. I have heard counsel for the parties and gone through the contents of the FIR. The petitioner, who is facing trial in the aforesaid case, which is triable by Magistrate, is in custody since 15.6.2006. Counsel for the petitioner contends that 11 prosecution witnesses are to be examined and till now, only examination-in-chief of two witnesses has been recorded, therefore, trial will take long time to conclude. Keeping in view the aforesaid facts, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the trial court and he is, accordingly, ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court/Duty Magistrate.
