Mr. Anter Singh Brar, Sr.D.A.G., Punjab ***** RAM CHAND GUPTA, J.(Oral) The present petition has been filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR No.90 dated 15.05.2010, under Sections 167/420/466 IPC, registered at Police Station Beas. I have heard learned counsel for the parties and have gone through the impugned order passed by learned Sessions Judge, Amritsar vide which the anticipatory bail application filed by the present petitioner was dismissed. CRM No.M-29590 of 2010 2 Brief allegations against the petitioner-accused are that he was posted as Patwari, Halqa Baba Bakala and that after his transfer inquiry was conducted by Seema Singh, Tehsildar and it was found that petitioner- accused had tampered with the revenue record. In the inquiry as many as 56 entries of Jamabandies for the year 2004-2005 as detailed in the list attached with the inquiry report had been found forged, fabricated or tampered with. It was also found that 13 entries of Jamabandies for the year 2005-2006 were altered or forged. There are serious allegations against the petitioner-accused regarding tampering with the official record. Hence, in view of these facts, it is not such a case in which extra- ordinary relief of anticipatory bail should be granted to the petitioner- accused. Rather his custodial interrogation is necessary to arrive at the truth. Hence, without expressing any opinion on the merit of the case, the instant application for anticipatory bail filed by Ashok Kumar is, hereby, dismissed being devoid of merit. October 13, 2010.
