Operative part
CORAM: HON'BLE MR.JUSTICE RAM CHAND GUPTA Present: Mr.Ashish Gupta, Advocate for the petitioner. ..... RAM CHAND GUPTA, J.(Oral) Crl.M.No.51633 of 2010 Application is allowed subject to all just exceptions. Crl.M.No.M-28872 of 2010 The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.47, dated 13.7.2010, under Sections 324, 148, 149 IPC and later on added Section 326 IPC, registered at Police Station Sadiq, District Faridkot. I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by learned Additional Sessions Judge, Faridkot, vide which application filed on behalf of the present petitioner for anticipatory bail was dismissed. Brief allegations against the petitioner-accused are that he along with co-accused while armed with deadly weapons had gone to the fields and caused injuries to the complainant. Petitioner-accused was armed with kirpan. He is the main accused. He caused grievous injury with kirpan to the complainant. Co-accused have already been released on anticipatory bail by learned Additional Sessions Judge. It is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioner-accused. Hence, in view of these facts, and without expressing any Crl.M.No.M-28872 of 2010 (O&M) -2- opinion on the merits of the case, the present petition filed by petitioner- Jagga Singh for grant of anticipatory bail is, hereby, dismissed being devoid of any merit.
