CORAM: HON'BLE MR. JUSTICE JITENDRA CHAUHAN Present: Ms. Satwant Mehta, Advocate for the petitioner. JITENDRA CHAUHAN, J. (Oral) The present petition has been filed under Section 438 of the Code of Criminal Procedure, for grant of anticipatory bail to the petitioners in case FIR No.188 dated 28.07.2012, registered under Sections 354, 506, 120-B of the Indian Penal Code, (for short, 'the IPC') and Section 67-A of the Information Technology Act, 2000, at Police Station Patti, District Tarn Taran. The learned counsel for the petitioners contends that the alleged video was recovered from Rahul, Karan and Love Brar, and not from the petitioner. The alleged incident occurred more than two years ago. He cites Siddharam Satlingappa Mhetre Vs. State of Maharashtra and others, 2011(2) Law Herald (SC) 1333. CRM No.M-27237 of 2012 -2- Heard. The allegation against the petitioner is that he along the husband of the complainant, who is stated to be a habitual drunkard, after taking drinks, tried to allure the complainant and in the process, some obscene videography was done. Thereafter, the video was circulated to Rahul, Karan and Love Brar. The case of the petitioner is that the said video was recovered, however, as per the record, the same is yet to be recovered. This is one of the exceptional cases where the person known to the family, enters the house and indulges in immoral activity like videography of the wife of his friend for the purpose of blackmailing her. Therefore, no case for grant of relief sought is made out.
