(ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.15 dated 16.02.2009 registered under Sections 304-B, 406, 498-A and 506 IPC at Police Station Bound Kalan, District Bhiwani. On the last date of hearing, the following order was passed:- “Counsel for the petitioner has stated that the petitioner has been now in custody for the last almost two years and for the last four dates, none of the prosecution witnesses (relatives of the deceased) has appeared for evidence and now rather bailable warrants have been issued for

1.2.2011. Counsel for the respondent, on instructions from SI Japan Singh, states that all the witnesses mentioned in the order dated 8.12.2010 will definitely be examined on the next date viz.

1.2.2011. Adjourned to 3.2.2011.” It is not disputed that even on 01.02.2011 no witnesses were examined. In the circumstances, I am constrained to order to direct the learned trial Court to release the petitioner on bail to its satisfaction. Petition stands disposed of.
