Subsequently, the petitioner was summoned on an application by the prosecution under Section 319 Cr.P.C. vide order dated

13.8.2007 to face trial with the other accused under Section 307/34 IPC. The order passed by the trial Court summoning the petitioner is extracted as below: “Addl. PP for the state filed an application under Section 319 Cr.P.C. dor summoning Baldev Singh as an additional accused who has been specifically named by Tarsem Lal PW in his statement recorded on oath in the Court as one of the assailants also. I have gone through the statement of PW Tarsem Lal and application of the prosecution. Baldev Singh son of Nazar Singh resident of Tehang is ordered to be summoned as additional accused to face trial with the present accused under 307/34 IPC for

12.9.2007.” Learned counsel for the petitioner submits that in terms of order passed by this Court on 21.9.2008, he has already furnished the bail bonds to the satisfaction of the trial Court.
