Judgment

Mr. Sumeet Puri, Advocate for the complainant. **** This is a petition for anticipatory bail filed in case bearing FIR No. 136 dated 20.07.2011, under Sections 307, 452, 294, 506 IPC and Sections 25/27 of the Arms Act, registered at Police Station Sadar Amritsar. On 11.08.2011 the following contention was noticed:- “Learned counsel has argued that even as per the allegations Section 307 IPC is not made out since the only allegation is of pointing a pistol.” Learned counsel for the complainant had sought time to file reply on two occasions. No reply has been filed. Learned DAG, on instructions from ASI Gurdev Singh, has accepted that there is no other case pending against the petitioner. In this view of the matter, I deem it appropriate to grant the concession of anticipatory bail to the petitioner. Let the petitioner appear before the investigating officer on 09.11.2011 between 10.00 a.m. and 4.00 p.m. and on any other date on which his presence is required by the investigating officer. The investigating officer shall release him on bail to his satisfaction, subject to the conditions laid down in Section 438(2) Cr.P.C. Petition stands disposed of.
