Gill, AAG, Punjab. * * * Petitioner Jagdev Singh, apprehending his arrest in a non- bailable offence in case FIR No. 131 dated 1.8.2006 under Sections 406, 420, 120-B IPC, registered at Police Station Samrala, District Ludhiana, has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail. I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 14.8.2006, passed by Additional Sessions Judge, Ludhiana, whereby bail application of the petitioner has been dismissed. As per allegations, petitioner took an amount of Rs. 2,71,000/- from the complainant for sending him abroad. During the investigation, it was found that subsequently, the petitioner also gave in writing that he will return Rs. 2,82,000/- to the complainant. Keeping in view the nature of allegations and the evidence collected during investigation, I am not inclined to grant the discretionary relief of anticipatory bail to the petitioner. Dismissed.
