Mr. Gaurav Garg Dhuriwala, AAG, Punjab. *** RAM CHAND GUPTA, J.(Oral) The present petition has been filed by Mukesh for anticipatory bail under Section 438 of Code of Criminal Procedure. in FIR No.139 dated

18.10.2009 under Sections 342/323/380/506/148/149 IPC registered at P.S. Anandpur Sahib, District Rupnagar. I have heard learned counsel for the parties and have gone through the whole record. This Court while issuing notice of motion on 28.01.2010 passed the following order:- Crl. Misc. No.M-2390 of 2010 2

Argues that no injury has been attributed to the petitioner and the main accused, namely, Pushvinder, Satish and Mashlu, to whom injuries have been attributed are on regular bail. Notice of motion for 03.03.2010. However, in the meantime, if the petitioner is arrested, he shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438(2) Cr.P.C.

It has been stated by ld. counsel for the petitioner that petitioner has already joined the investigation in pursuance of said order dated

28.01.2010. It has also been stated by ld. counsel for the State, on instruction from ASI.Balwinder Kumar, that petitioner has joined the investigation and that he is no more required for any custodial interrogation. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Hence, in view of these facts and without expressing any opinion on the merits of the case, the anticipatory bail application filed by Mukesh is accepted and order dated 28.01.2010 granting interim bail to the petitioner, is hereby confirmed subject to compliance of conditions laid down in Section 438(2) Cr.P.C.
