Judgment
CORAM: HON'BLE MR. JUSTICE MEHINDER SINGH SULLAR Present:- Mr.Rajiv Kataria, Advocate for the petitioners. M ehinder S ingh S ullar, J. (Oral) Petitioners Harvinder Singh and his wife Sonal Duggal have directed the instant petition for quashing the impugned complaint (Annexure P13) filed by the respondent-Haryana State Pollution Control Board under section 15 read with Section 19 of the Environment Protection Act, 1986, summoning order dated
Operative part
17.3.2010 (Annexure P14) and all other subsequent proceedings arising therefrom, invoking the provisions of Section 482 Cr.PC. What cannot possibly be disputed here is that all the points raised in the present petition have already been considered, decided and negatived by this Court while deciding a bunch of similar petitions, by virtue of detailed judgment in case M/s Ansal Properties and Infrastructure Ltd. & Ors. vs. Haryana State Pollution Control Board and Arvinder S.Brara vs. Haryana State Pollution Control Board, reported as 2012(3) RCR (Criminal) 138, in which, the present counsel also represented one of the similarly situated petitioner. He fairly conceded that the controversy involved is squarely covered and the instant petition is liable to be decided in the same terms. In view of the law laid down by this Court in M/s Ansal Properties and Infrastructure Ltd. & Ors. and Arvinder S.Brara's cases (supra), as there is no merit, therefore, the present petition is hereby dismissed as such.
