Present: Mr.Jasjit Singh, Advocate, for the petitioner. **** SABINA, J. This petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No. 62 dated 1.7.2010 under Section 61 of the Punjab Excise Act, 1914 registered at Police Station Mamdot, District Ferozepur. The contents of the FIR, as reproduced in para 2 of the petition read as under:-

On 1.7.2010, HC Balwinder Singh No.1931, C-2 Harjinder Singh No.993 and PHG Satnam Singh No.5576 and PHG Jarnail Singh No.No.5689 and PHG Gurpritam Singh 5535 and PHG Balwinder Singh 5588 were present on the road of village Sahanke where I received a secret information to the effect that Gurmeet Criminal Misc. No.M- 20640 of 2010 (O&M) -2- Singh Tikotia Wala son of Harnam Singh and his wife Amro @ Sumitra Caste Rai Sikh, resident of Basti Kashmir Singh Dakhli Laklha Singh Wala Hitad, P.S.Mamdot and Balwinder Singh son of Gurdip Singh Caste Rai Singh, resident of village Chananwali Mandi, near Fazilka who is brother-in-law of Gurmit Singh (Sala) were inhabit of selling and distillate of illicit liquor, if raid was conducted at the house of Gurmit Singh, large quantity of liquor could be recovered.

After hearing learned counsel for the petitioner, I am of the opinion that the instant petition deserves dismissal. On an information received by the police officials, the house of the petitioner was raided. The petitioner, however, managed to escape from the spot. 150 bottles of illicit liquor were recovered from the spot. The petitioner might be required for custodial interrogation. Keeping in view the seriousness of offence alleged to have been committed by the petitioner, no ground for grant of bail is made out. Accordingly, this petition is dismissed.
