RAM CHAND GUPTA, J.(Oral) The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.80, dated 7.5.2010, under Sections 307, 326, 336, 323, 324, 148, 149 IPC (offences under Sections 307 and 326 IPC added later on) and under Sections 25, 54, 59 of Arms Act, registered at Police Station Dhariwal, District Gurdaspur I have heard learned counsel for the petitioner and have gone through the whole record carefully. Brief allegations against the petitioner-accused are that he alongwith co-accused caused injuries to the complainant party and three persons, namely, Jasbir Singh, Jagbir Singh and Gurbhej Singh were injured. Petitioner was armed with dattar and he caused grievous injury on right leg of the complainant. He is the main accused. Co-accused, i.e., son of the present petitioner was granted anticipatory bail by this Court as he was attributed simple injury on the hand. Hence, it is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioner-accused. Hence, in view of these facts, and without expressing any opinion on the merits of the case, the present petition filed by petitioner- Gurcharan Singh @ Gurcharanjit Singh for grant of anticipatory bail is, Crl.M.No.M-19916 of 2010 (O&M) -2- hereby, dismissed being devoid of any merit.
