CORAM: HON'BLE MR. JUSTICE KANWALJIT SINGH AHLUWALIA Present: None for the petitioner. Ms. Jaspreet Kaur, Assistant Advocate General, Punjab. Kanwaljit Singh Ahluwalia , J. (Oral): This Court on 23.1.2012 had passed the following order:- “Present petition has been filed under Section 438 Cr.P.C. for the grant of pre-arrest bail to the petitioner in a case arising out of FIR No.403 dated 21.12.2007, registered at Police Station Kharar, District Mohali, under Sections 279, 337 and 338 of the Indian Penal Code. Counsel for the petitioner submits that under mistaken impression, the petitioner could not appear before the trial court on the date fixed. Hence, in case of bailable offences, his bail was cancelled and non-bailable warrants were issued against him. Issue notice of motion to Advocate General, Punjab for

13.2.2012. In case the petitioner appears before the trial court on or before 6.2.2012, he shall be released on interim bail.” No body had caused appearance for the petitioner on 13.2.2012. The order dated 13.2.2012 reads as under:-
Case called thrice. No body is present on behalf of the petitioner. Shri J.S. Bhullar, Counsel for the State, on instructions from ASI Amrit Lal, submits that the petitioner has not complied with the order passed by this Court and he has not appeared before the trial court. However, In the interest of justice, adjourned to 16.2.2012.
